rights of others and expects its users to do the same. In accordance with the
Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously
to claims of copyright infringement that are reported to our Designated
Copyright Agent.
How to File a Takedown Notice
If you are a copyright owner or an agent thereof and believe
that any content hosted on Jiinubi servers
infringes upon your copyrights, you may submit a notification pursuant to the
DMCA by providing our Copyright Agent with the following information in writing
(see 17 U.S.C 512(c)(3) for further detail):
Identification
of the Work: A description of the copyrighted work that you claim
has been infringed.
Identification
of the Infringing Material: The specific URL(s) or location where
the infringing material is located on our service.
Contact
Information: Your full legal name, mailing address, telephone
number, and email address.
Good
Faith Statement: A statement that you have a good faith belief
that use of the material in the manner complained of is not authorized by
the copyright owner, its agent, or the law.
Perjury
Statement: A statement that the information in the notification
is accurate, and under penalty of perjury, that the complaining party is
authorized to act on behalf of the owner of an exclusive right that is
allegedly infringed.
Signature: A
physical or electronic signature of the copyright owner or a person
authorized to act on their behalf.
Removal: We
will expeditiously remove or disable access to the infringing material.
Notification: We
will notify the affected user (the Subscriber ) that the material has
been removed.
Repeat
Infringers: We reserve the right to terminate accounts that are
found to be repeat infringers in accordance with our internal policy.
How to File a Counter-Notice
If your content was removed but you believe it was not
infringing (or that you have the rights to use it), you may send a Counter-Notification to
our Copyright Agent. It must include:
Identification
of Material: The material that was removed and the location (URL)
where it appeared before removal.
Perjury
Statement: A statement under penalty of perjury that you have a
good faith belief that the material was removed or disabled as a result
of mistake or misidentification.
Consent
to Jurisdiction: A statement that you consent to the
jurisdiction of the Federal District Court for the judicial district in
which your address is located (or [Insert Jiinubi s
Local District] if you are outside the U.S.), and that you will accept
service of process from the person who provided the original
notification.
Contact
Info & Signature: Your name, address, phone number, and
physical or electronic signature.
What happens next?
Upon receipt of a valid Counter-Notice, Jiinubi
will forward a copy to the original complaining party. If the complaining party
does not file a lawsuit and provide us with proof within 10 14 business
days, we will restore the removed material.
